Acceptable Use Policy
When you purchase hosting services from Metroservers you agree to abide by the following Acceptable Use Policy. Metroservers reserves the right to suspend or cancel any account that we consider has been inappropriately used or violates this policy.

 

Bandwidth and Disk Usage
When you purchase a hosting account with Metroservers you agree that you will not exceed the bandwidth or disk space limits that are applicable to your hosting plan. We monitor each account’s usage levels and we reserve the right to take corrective action if your bandwidth or disk usage exceeds the applicable amount for your hosting plan. At our discretion, this may include the assessment of additional charges, disconnection or discontinuance of any and all Services, or termination of this Agreement. We will always contact a customer as soon as an overage is recorded, and attempt to help you to resolve the situation.

Websites falling under the following categories are not entitled to receive unmetered bandwidth. Please see the limits below.

Website Categories:
Audio/Video Downloads
Audio/Video Streaming
File Download Service similar to rapidshare or megaupload
Heavy torrent sites

Monthly Bandwidth Limits:
1,000  GB/mo for Shared Standard
2,000  GB/mo for Shared Webmaster
4,000  GB/mo for Shared Professional

Traffic is Unmetered, not Unlimited. We do not monitor your traffic usage on a Shared Hosting plan.  It simply means that you will never be billed for extra traffic or a high number of visitors to your web site. But, in order to keep a reliable shared hosting environment, we need to make sure every users are sharing the hosting resources equitably. This is why we need to enforce our maximum resource usage policy. If your web site is detected as using too much server resources, most of the time caused by cpu intensive perl or php scripts or database applications, we will allow you some time to fix the issue. If the issue can't be fixed, we will invite you to move your web site to your personal dedicated server or virtual private server.

If the overage continues and an account uses 20% more disk space or bandwidth, the account may be suspended. If Metroservers takes any corrective action under this section, the customer shall not be entitled to a refund of any fees paid in advance prior to such action.

 

CPU Usage
If your hosting account continuously uses excessive amounts of CPU processing on any of our servers Metroservers reserves the right to impose additional charges, and / or suspend and cancel your account. This will only be done in extreme circumstances; we will work with you to prevent this situation arising if possible. What constitutes excessive CPU usage is decided at Metroservers’s discretion only.

Without our permission, User may not:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network
e) Run cron entries with intervals of less than 15 minutes
f)  Run hosting space  as offsite storage for electronic files or for third party electronic mail or FTP hosts.


Simply exceeding the limit does not constitute grounds for suspension however accounts that constantly create and delete large numbers of files on a regular basis or causing file system damage may cause your account to be flagged for review.

How can I know if my website uses a lot of resources?
It is necessary to study your website and the way the scripts are written to know if the site uses a lot of resources. The complexity of the scripts combined with the number of visitors will help us determine if a web site uses too much resources for Shared Hosting or not. If your site is new or if it is currently hosted on a Shared Hosting plan at another host without any known issue, you probably do not use a great deal of resources and you can open your shared hosting account at Metroservers with peace of mind!

 

Email Accounts
Storage space for email will be counted towards your hosting account. Metrosevers does not limit how big your email accounts can be outside your hosting package's space limit.

 

What can I use my hosting account for?
Generally you can use your hosting account for almost any website and many internet related activities. There are a few exceptions that we list below, but if you are concerned that the content of your site may violate any policies please contact us prior to signup. Please be aware that if we become aware of any hosting account being used for illegal activities it will be suspended and the appropriate authorities informed. It is at our discretion what constitutes illegal content.

 

Spamming
Metroservers has a zero-tolerance policy on spamming, or UBE/UCE (unsolicited bulk email/unsolicited commercial email). This policy protects our customers as well as the Internet community from the negative effects of "spam" related activity. Metroservers defines spam as unsolicited broadcast or commercial email that is sent to addresses that do not affirmatively and verifiably request such material from that specific sender. This includes intentionally sending unsolicited email, or if you maintain an open mail relay on your account or server.

Your account will immediately be suspended on discovery of any similar activities. All users are responsible for maintaining a working email contact and updating that information with Metroservers when it changes so we can get in touch to prevent loss of services in such a situation. Forging, misrepresenting, omitting or deleting message headers, return mailing information and/or Internet protocol addresses to conceal or misidentify the origin of a message is also not allowed on Metroservers’s servers.

 

Abusive Material
Metroservers does not allow on its servers any content which is, in any way, racist, sexist, homophobic, or which seeks to defame in any manner any ethnic or other social group.

 

Illegal Material
This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any US and worldwide regulations.

 

Adult Content and Child Pornography
Metroservers allows legal adult contents. Any type child pornography is not allowed. Use of our servers to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. Metroservers is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, Metroservers’s services.

 

Viruses and Hacking
Metroservers doesn’t allow a hosting account to be used for creating or transmitting viruses, worms or Trojans of any kind for any purpose. Any attempt to use Metroservers’s services to access computers, accounts or networks illegally, or any other form of hacking, is also prohibited.
